October 24, 2016: The Prime Minister of
India, Narendra Modi, took a clear position disapproving the
muslim men's right to divorce their spouse based on triple talaq
chant. The muslim women activists in particular and a vast
majority of Indians all across have welcomed the pronouncement
by the Prime Minister, who said it was neither a political nor
religious, but a development issue. |

Description |
In the triple ṭalaq
divorce, the husband pronounces the phrase "I divorce you"
thrice to his wife. A man may divorce his wife three times,
taking her back after the first two (reconciling). After
pronouncing Talaq either once or twice or thrice, the man has to
wait for 3 menstrual periods before finally letting his wife
leave. However, if the couple want to come together after the
Talaq is completed, the Quran states that there is no harm in
doing so after the wife has married another man and has divorced
him (known as 'Talaq Halala'). Some do a "triple ṭalāq", in
which the man says in one sitting "I divorce you" three times
(or "I divorce you, three times", "you're triple divorced").
The muslim women have never been able to accept this phenonmenon
because it deprives them of their natural rights as human
beings. So many of them, through the aegis of women activists
and advocates, have been challeging such divorces. It is largely
felt that the triple talaq phenomenon is also against the basic
spirit of the Indian Constitution. Despite this many muslim male
dominated organisations have opposed the Governments
indulgence to ban triple talaq. Some of the vote bank exploiting
political parties have also opposed the Goverments stand point
on this issue, disregarding what the Indian Constitution
dictates. |
